Service and payment agreement

Terms and conditions of service

By accepting the terms and conditions of service, the client confirms that he/she has read and understood the following document and that he/she accepts and agrees with our terms and conditions of service.

The client accepts that the technical staff designated by rockfence for the provision of services will enter the property requested by the client to carry out the agreed works. The technical staff will use the paths, trails, streets and/or corridors necessary inside and outside the property in order to achieve the final completion of the work during the time it takes to complete it.

The client will be responsible for establishing the perimeters and measurements based on what is established by urban regulations or legal restrictions.

The client will be responsible for the delimitation agreements with the areas adjacent to his/her property, whether public or private property.

The client agrees and recognizes that the service provided must transform and affect the surrounding area and may partially damage the land or immediately adjacent vegetation.

The client accepts and acknowledges that Rockfence may request, before starting the work, for safety reasons, a professional study of the terrain in order to detect possible underground works. These studies and their costs will be the responsibility of the client and will not affect in any way the agreed value for the execution of the work.

The client accepts and acknowledges having the legal authority to authorize the services provided by Rockfence. If not, the client will be responsible for any conflicts that such authorization may generate in the future or during the installation of the work itself.

Rockfence will not be responsible for charges or conflicts generated by the action or omission of third parties.

Payment agreements

The client agrees to make timely payments of invoices generated based on the work requested and previously stipulated and agreed.

The client agrees to make timely payments generated based on additional charges for situations or changes in the work that occur due to events beyond the responsibility and commitment of Rockfence.

REASONS THAT MAY GENERATE EXTRA CHARGES

There are circumstances that may generate extra charges to what was initially agreed with the client. These circumstances are events or problems that existed previously or subsequently and that were not taken into account for reasons beyond the responsibility of the Rockfence quote management and its technical staff, or due to action or omission of the information provided by the client regardless of whether it was due to ignorance. Some typical cases are mentioned below:

1-Changes in the characteristics of the terrain that were not detected because they were covered, concealed, or buried, making their detection impossible with standard inspection methods.
2-Situations that require the rental of specialized equipment not stipulated for a standard installation.
3-Unforeseen high-risk situations that endanger the physical integrity or health of the technicians in operation.
4-Exceptional situations that require the subcontracting of specialized companies. Example: Electricity, plumbing, chemical products, toxic gases, dangerous animals, explosives, etc.
